Application of Wisconsin Power and Light Company and Sheboygan Power, LLC for a Certificate of Public Convenience and Necessity for an Electric Generation Facility to be Located in Sheboygan County - (6680-CE-168)  
The request to build this plant was granted in May 2005.  The court found that while there was potential for more cost-effective energy efficiency available than what was reflected in WP&L’s application, it was not practical to achieve a reliable level of additional savings in the amount of time remaining before the projected in-service date of the proposed facility.  Additionally the PSC found that conservation and renewable resources could not fulfill the demand the facility was designed to meet.

E4, Inc. appeared in this proceeding as a party-intervenor.  E4 maintains that the record in this docket establishes that the potential for energy efficiency with the Applicants’ service territory was understated in the studies conducted by the Applicants, and that the Applicants’ energy efficiency analysis did not conform to the Commission’s standard for compliance with Wisconsin’s Energy Priorities Law. Additionally, E4 contends that these proceedings demonstrate the need to eliminate disincentives to utilities’ investment in energy efficiency projects, and to create economic support for the energy policy articulated in the Energy Priorities Law.
