| Wisconsin Public Service Corporation (WPS) applied for a 515 MW baseload coal-fired electric generating facility to be installed adjacent to the existing Weston Generating Station Unit 3 on WPSC property that straddles the villages of Rothschild and Kronenwetter in Marathon County. The project was approved by the Commission in October 2004, and is expected to be in service in 2008. |

| E4 asserts that the Public Service Commission has the responsibility under the Energy Priorities Statute, to look FIRST at ways to meet the demand for which Weston 4 is to be built, by using energy efficient technology. Only after the options for meeting demand with energy efficient technology have been pursued, can the commission approve new plant construction. |

| E4 maintains that the record in this docket establishes that (1) the potential for energy efficiency within the Wisconsin Public Service Corporation (WPS) service territory has been significantly underestimated; and (2) the Application for a Certificate of Public Convenience and Necessity (CPCN) as presented does not allow the Public Service Commission (PSC) to meet its obligations under the Energy Priorities Law. Finally, E4 contends that these proceedings demonstrate that the current CPCN process includes critical flaws that must be remedied in this and future CPCN dockets. |
